This Privacy Policy explains how EluNoire, a store operated by Algorabia LLC (Wyoming, United States), collects, uses, shares, and protects personal information when you use our website, products, and services (the "Service"). It also describes the privacy rights you may have and how to exercise them.

1. Information we collect

We collect only the information we need to operate the Service and fulfill your orders.

Information you provide

  • Contact and order details: your name, email address, shipping address, and billing details, and the items you order. We offer guest checkout, so we do not create an account or store a password for you.
  • Custom design content: images, text, and other materials you upload or enter to personalize a product.
  • Communications: messages you send us by email or other channels, and your marketing preferences.

Information collected automatically

  • Device and usage data: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, and timestamps.
  • Cookies and similar technologies: small files and identifiers stored on your device. See Cookies and tracking.

Information from third parties

  • Payment information: our payment processor (Stripe) handles your payment. We receive a confirmation and limited metadata (such as the card brand and last four digits and the billing country), not your full card number.
  • Fulfillment partners: our print and shipping partners provide order, production, and tracking status.

We use personal information to:

  • Process and fulfill your orders, including sharing data with print and shipping partners, and sending you order, mockup-approval, shipping, and delivery emails. Legal basis: performance of a contract.
  • Provide, maintain, secure, and improve the Service, and detect, prevent, and respond to fraud, abuse, and security incidents. Legal basis: our legitimate interests in running and protecting the Service.
  • Measure usage and advertising performance through analytics and advertising technologies. Legal basis: your consent.
  • Send marketing communications where you have opted in. Legal basis: your consent.
  • Comply with legal obligations, such as tax, accounting, and responding to lawful requests, and to establish, exercise, or defend legal claims. Legal basis: legal obligation and our legitimate interests.

We do not sell your personal information for money.

3. Custom designs and uploads

Images and text you upload to personalize a product are stored so we can produce and ship your order. We may keep a copy after fulfillment to handle reprints, support requests, and to defend against legal claims. We do not use your uploads to train AI models, and we do not share them with third parties beyond what is needed to fulfill your order.

4. Marketing communications

If you opt in, we may send you promotional emails about products, offers, and news. You can withdraw consent and unsubscribe at any time using the link in any marketing email or by emailing [email protected]. Opting out of marketing does not stop transactional messages about orders you have placed (confirmations, approvals, shipping, and support replies), which are not marketing.

5. Cookies and tracking

We use cookies and similar technologies for:

  • Essential purposes — remembering your cart, securing the Service, and making checkout work. These are always on because the Service cannot function without them.
  • Analytics — understanding how the Service is used so we can improve it. We use Google Analytics and PostHog.
  • Advertising — measuring and improving our ads. We use advertising pixels from Meta, Google Ads, TikTok, Pinterest, and Snapchat.

Analytics and advertising technologies load only with your consent. You can give, refuse, or change your choices through our cookie consent banner, and you can also control cookies through your browser settings. Disabling essential cookies may break parts of the Service.

6. How we share information

We share personal information only as needed to operate the Service, with the following categories of recipients (our "sub-processors"):

  • Payments: Stripe.
  • Print and fulfillment: Printify and its print and shipping partners.
  • Email delivery: Resend.
  • Hosting and backend infrastructure: Convex and our hosting providers.
  • Analytics and advertising: Google Analytics, PostHog, Meta, Google Ads, TikTok, Pinterest, and Snapchat (subject to consent).

We may also share information for legal and safety reasons (to comply with law or lawful requests, or to protect the rights, property, or safety of EluNoire, our users, or others), and in connection with a business transfer (merger, acquisition, or sale of assets), subject to this Policy.

We do not sell your personal information for money. However, our use of advertising technologies may be considered "selling" or "sharing" for cross-context behavioral advertising under certain US state laws (such as California's CCPA/CPRA). 7. International transfers

We are based in the United States, and we and our service providers may process and store information in the United States and other countries whose data-protection laws may differ from yours. Where we transfer personal data from the EU, UK, or other regions, we rely on appropriate safeguards (such as the European Commission's Standard Contractual Clauses) where required by law.

8. Your rights

Your rights depend on where you live. We honor the rights available to you under applicable law and do not discriminate against you for exercising them.

EU / UK (GDPR)

You may have the right to access, correct, delete, or receive a portable copy of your personal information; to restrict or object to certain processing; and to withdraw consent at any time (without affecting processing already carried out). You also have the right to lodge a complaint with your local data-protection supervisory authority.

United States (including California)

Depending on your state, you may have the right to know and access the personal information we hold, to delete it, to correct it, to opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising, and to limit the use of sensitive personal information. We do not sell personal information for money, and you can opt out of advertising-related sharing through our cookie consent banner. You may use an authorized agent to submit a request.

How to exercise your rights

Email [email protected] and tell us what you would like to do. We may need to verify your identity before acting on your request, and we will respond within the timeframes required by applicable law.

9. Data retention

We keep personal information only for as long as we need it for the purposes in this Policy, including to fulfill orders, provide support and reprints, comply with tax and other legal obligations, resolve disputes, and enforce our agreements. When we no longer need information, we delete or anonymize it.

10. Security

We use technical and organizational measures to protect your information, including encryption in transit and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

11. Children

The Service is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child under 16 has provided us with personal information, contact [email protected] and we will delete it.

12. Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date above. If changes are material, we will provide additional notice, for example by email or a prominent notice on the Service.
